Terms & Conditions

These terms and conditions are entered into by and between PROVEN GYM LTD and the Member.

Services:

The membership entitles the usage of PROVEN GYM LTD facilities and the equipment and services available therein. The membership gives access to all PROVEN GYM LTD sites, except if specified otherwise.

Membership:

The membership is personal and cannot be shared.

Age Limit:

The Member confirms that he/she is 18 years old or older.
For persons 16 or 17 years old, exceptions are granted based on written parental consent. Persons under 16 years of age must be supervised at all times.

Health:

The Member confirms that he/she does not suffer from health problems that would hinder exercise or prevent him/her from engaging in exercise, or that would be detrimental or averse to the Member’s health, safety or physical condition if he/she did exercise. In case of any doubt, the Member shall seek advice from a medical doctor who should confirm the ability to exercise.

PROVEN GYM LTD shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition. If an assessment is done at PROVEN GYM LTD, it is for the sole purpose of compiling comparative data in order to track the Member’s progress in a programme and not for diagnostic purposes.

Liability:

Each Member of PROVEN GYM LTD shall be liable for any property damage and/or personal injury caused by the Member on the PROVEN GYM LTD premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.

Waiver of Liability:

Any and all use of the PROVEN GYM LTD facilities shall be at Member’s own risk at all times. The Member shall not utilise any equipment unless he/she knows the appropriate usage. PROVEN GYM LTD shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.

Lost Property or Theft:

PROVEN GYM LTD does not take responsibility for loss or theft of any personal belongings. Any items left on PROVEN GYM LTD premises will be kept for a period of two weeks before being disposed of.

Access & Security:

Small Group Personal Training sessions and Fitness Classes are available according to the times stated in the PROVEN GYM LTD booking system. Classes and instructors are subject to change with no prior notice.

Outside of core hours (7am - 5pm, Monday - Friday) members must call the allocated access number to open and close the gate.

Access to the premises is strictly limited to active members only. Each member will be issued a personal access fob, which is for their individual use only. Members must not share their fob or allow non-members to enter the building using their access privileges.

Fobs remain the property of PROVEN GYM LTD and must be returned upon termination or expiration of membership. Failure to return the fob within 7 days of membership ending will incur a £30 replacement fee, which will be charged to the member’s account.

Misuse of the fob or unauthorised access by non-members may result in suspension or termination of membership. Members are responsible for ensuring that doors are properly closed behind them and for reporting any security breaches or unauthorised access to staff immediately.

Sessions:

All Small Group Personal Training sessions and Fitness Classes at PROVEN GYM LTD must be used within the designated weekly or monthly period, depending on your membership type. Unused sessions cannot be carried over into the following week or month and will be forfeited.

Cancellations must be made no later than 15 minutes before the scheduled start time of the session. If a cancellation is not made within this timeframe, the session will be deducted from your membership or session pack.

Payment:

The Member is responsible for the payment of the membership. This is true even if the amount is debited directly by PROVEN GYM LTD. Agreed price only applies if the Member pays according to the agreed conditions. If the payment is late the Member will receive a reminder email from PROVEN GYM LTD and access may be suspended. The membership continues to run even if the access is suspended. If after 30 days the amount is still not paid the Member is in violation of the contract and the total outstanding amount of the contract will be due. PROVEN GYM LTD may transfer the case to a debt collector, which will add additional fees.

Monthly payment or pro rata amount and any sign-up fee are paid at the point of this agreement. The Member has given approval for an automatic debit from his/her account or card.

Monthly Rolling Agreement:

Bills on the 1st and prorates partial months.

Membership Tier:

Memberships can be upgraded at any time. If you wish to downgrade, we require one full month’s notice. If cancellation notice has been given, membership downgrades are unable to be authorised. Please email any requests to contact@provengym.co.uk.

Cancellation:

All memberships have three full months minimum commitment. We require two full months’ cancellation notice. (i.e. if notice is given on 14th March, your notice period will begin from the 1st April, with your last full payment on 1st May and your membership expiring on 31st May).Freezing of any memberships is not permitted. All membership cancellation notices must be sent to contact@provengym.co.uk. Cancellation notices need to be emailed in between 8am to 5pm, Monday to Friday, to be processed the same day.

Exceptional Cancellation:

A cancellation is exceptionally granted due to medical reasons, upon presentation of a medical certificate, at the discretion of PROVEN GYM LTD.

Price Changes:

Prices will increase in line with inflation.
