Terms & Conditions

These terms and conditions are entered into by and between PROVEN GYM LTD (hereinafter: “PROVEN GYM LTD”) and you (hereinafter: “the Member”). These Terms and Conditions apply to all services provided by PROVEN GYM LTD, including introductory programmes (such as 6-week or 28-day offers) and ongoing membership subscriptions. By purchasing any PROVEN GYM LTD service or programme, you (“the Member”) agree to be bound by these Terms and Conditions.

Services

The membership or programme entitles the Member to use PROVEN GYM LTD facilities, equipment, and services as set out in their specific plan or agreement.

Membership and Programmes

The membership is personal and non-transferable.

Initial programmes (e.g., 6-week or 28-day programmes) are fixed-term, pre-paid packages that provide access to PROVEN GYM LTD facilities and coaching for the duration stated at purchase.

Memberships are ongoing subscriptions that continue monthly until cancelled in accordance with these Terms. Upon completion of an initial programme, if you choose to continue as a Member, your participation will automatically fall under the Membership terms outlined below without requiring a new signature.

Age Limit

The Member confirms that they are 18 years old or older. For persons aged 16 or 17, exceptions are granted based on written parental consent. Persons under 16 must be supervised at all times.

Health

Members and participants confirm that they do not suffer from health problems that would hinder exercise or be detrimental or adverse to their health, safety, or physical condition if they did exercise. In case of any doubt, members and participants shall seek advice from a medical doctor who should confirm the ability to exercise. PROVEN GYM LTD shall have no obligation to perform a fitness assessment or similar testing to determine the members’ and participants’ physical condition. If an assessment is done at PROVEN GYM LTD, it is for the sole purpose of compiling comparative data in order to track members’ and participants’ progress in a programme and not for diagnostic purposes.

Liability

Each Member of PROVEN GYM LTD shall be liable for any property damage and/or personal injury caused by the Member on the PROVEN GYM LTD premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.

Waiver of Liability

Any and all use of the PROVEN GYM LTD facilities shall be at the Member’s own risk at all times. The Member shall not utilise any equipment unless they know the appropriate usage. PROVEN GYM LTD shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.

Lockers for Personal Belongings

Lockers are available for Members while working out in the facility. Each Member needs to empty the locker when leaving the facility. PROVEN GYM LTD will open and empty lockers if the Member is not in the facility.

Lost Property or Theft

PROVEN GYM LTD does not take responsibility for loss or theft of any personal belongings. Any items left on PROVEN GYM LTD premises will be kept for a period of two weeks before being disposed of.

Code of Conduct

The Member shall respect the behavioural and operating principles of PROVEN GYM LTD, as laid out in the Code of Conduct.

Suspension / Termination of Membership

If the Member behaves in a way that breaches the Code of Conduct, membership can be suspended or terminated at management’s sole discretion.

Access and Security

Small Group Personal Training sessions and Fitness Classes are available according to the times stated in the PROVEN GYM LTD booking system. Classes and instructors are subject to change with no prior notice.

Outside of core hours (7am - 5pm, Monday - Friday) members must call the allocated access number to open and close the gate.

Access to the premises is strictly limited to active members only. Each member will be issued a personal access fob, which is for their individual use only. Members must not share their fob or allow non-members to enter the building using their access privileges.

Fobs remain the property of PROVEN GYM LTD and must be returned upon termination or expiration of membership. Failure to return the fob within 7 days of membership ending will incur a £30 replacement fee, which will be charged to the member’s account.

Misuse of the fob or unauthorised access by non-members may result in suspension or termination of membership. Members are responsible for ensuring that doors are properly closed behind them and for reporting any security breaches or unauthorised access to staff immediately.

Sessions

Membership: All Small Group Personal Training sessions and Fitness Classes at PROVEN GYM LTD must be used within the designated weekly or monthly period, depending on your membership type. Unused sessions cannot be carried over into the following week or month and will be forfeited.

Initial Programmes: All Small Group Personal Training sessions and Fitness Classes at PROVEN GYM LTD must be used within the designated timeframe stated in your programme (i.e., 6 Weeks or 28 Days, depending on the Initial Programme purchased). Unused sessions cannot be carried over unless otherwise stated at the time of purchase.

Programme Completion and Conversion

Upon completing an Initial Programme, Members may choose to continue with an PROVEN GYM LTD membership. In this case, all Terms and Conditions set out herein remain in effect and no additional signature is required.

Refunds and Transfers

All payments made for an Initial Programme or Membership are non-transferable.

Refunds will only be issued in the following circumstances:

Initial Programmes: A refund may be granted under our money-back guarantee, including after the programme has commenced, provided a written request is submitted to contact@provengym.co.uk at the earliest convenience, as outlined in the Satisfaction Guarantee section below.

Memberships: A refund may be granted only where you are within the 7-day cooling-off period and services have not yet commenced, as detailed in the Satisfaction Guarantee section below.

All other refunds will only be issued where required by law.

Payment

For Initial Programmes, payment is taken in full at the point of purchase. Initial Programmes are non-transferable; however, they are covered by our money-back guarantee, as outlined in the Satisfaction Guarantee. If a Member is not satisfied after commencing an Initial Programme, a refund may be requested in writing to contact@provengym.co.uk at their earliest convenience.

For Memberships, the Member is responsible for all payments due under the agreement, including payments debited directly by PROVEN GYM LTD. The agreed price applies only where payments are made in accordance with the agreed terms. Membership payments are subject to a 7-day cooling-off period, provided services have not yet commenced.

If a Membership payment is late, the Member will receive a reminder email from PROVEN GYM LTD and access may be suspended. The Membership agreement continues to run during any suspension. If payment remains outstanding for 30 days, the Member will be considered in breach of contract and the full outstanding balance will become immediately due. PROVEN GYM LTD may refer the debt to an external collection agency, which may result in additional fees.

The first monthly payment (or pro-rata payment) and any applicable sign-up fee are taken at the point of this agreement. By entering into this agreement, the Member authorises PROVEN GYM LTD to automatically debit payments from their nominated account or card.

Monthly Rolling Agreement

The Membership operates on a monthly rolling basis and continues until cancelled in accordance with these Terms and Conditions.

Membership fees are billed on the 1st day of each calendar month. Where a Membership begins partway through a month, the first payment will be pro-rated to reflect the number of days remaining in that month.

If a Member wishes to request a change to their billing date, this must be submitted in writing to contact@provengym.co.uk. Any change is subject to approval and may not take effect until the following billing cycle.

Communication and Updates

PROVEN GYM LTD may contact you via email, phone, SMS, or WhatsApp regarding your sessions, payments, and membership status. By agreeing to these Terms, you consent to such communication.

Satisfaction Guarantee

We provide a money-back guarantee on all Initial Programmes. If, after starting your Initial Programme, you are not satisfied with the service, you may request a refund by submitting your request in writing to contact@provengym.co.uk.

A 7-day cooling-off period also applies to all Memberships, commencing from the date of purchase, provided that membership services have not yet commenced.

Renewal and Cancellation

Initial Programmes: As these are short, fixed-term programmes, no notice or cancellation is permitted once the programme begins, except under exceptional circumstances (e.g., medical grounds with evidence).

Memberships: All memberships have three full months minimum commitment. We require two full months’ cancellation notice (i.e. if notice is given on 14th March, your notice period will begin from the 1st April, with your last full payment on 1st May and your membership expiring on 31st May). All cancellations must be emailed to contact@provengym.co.uk between 8am to 5pm, Monday to Friday, to be processed the same day (excluding closure periods). Please note our office will be closed from 23rd December to 1st January. Any cancellation requests received during this period will be processed from 1st January.

Exceptional Cancellation: A cancellation is exceptionally granted due to medical reasons, upon presentation of a medical certificate, at the discretion of PROVEN GYM LTD.

Conversion: If you transition from a Initial Programmes to a Membership, your membership is governed by the Membership Cancellation Policy from the start of your first monthly payment.

Pauses / Freezes

PROVEN GYM LTD does not offer membership pauses or freezes for any reason other than those required by law or explicitly stated in these Terms. Membership continues to renew monthly unless cancelled in accordance with the notice period above.

Membership Tier:

Memberships can be upgraded at any time. If you wish to downgrade, we require one full month’s notice. If cancellation notice has been given, membership downgrades are unable to be authorised. Please email any requests to contact@provengym.co.uk.

Price Changes

Any price changes will be communicated at least one month prior to implementation.

Referral Scheme

Refer a friend to PROVEN GYM LTD and receive 50% off one month’s membership when they sign up.

The referee must be an active PROVEN GYM LTD member. If the referee gives notice and the discounted month falls within their notice period, or if the referred individual cancels before the referee receives the discounted month, the referral benefit will be void.
